is this a design flaw?

My 2009 versa's vents seem to blow semi-warm air, even when the control is set to let outside air in. Even if the outside air on a Summer evening is cool, the air coming thru the vents is warm. I kinda think this might just be a design flaw, because the hotter the engine is, the warmer the air that blows in from the "outside". Maybe the air hoses are too close to a hot engine component?
Has anyone else noticed this? Or is it maybe a repair issue I've gotta take to my dealer.
Thanks,

Think of it like this. The air coming through the vents when the system is set to fresh (not recirculated), has to be coming from outside of the car somewhere. That somewhere is no doubt from somewhere near the front of the car. The engine also happens to be at the front of the car. The engine happens to throw off a lot of heat.

I have also noticed on every car I have owned that when it is a nice cool day and you don't want to run the AC and you just have the vents on hoping to bring in some cool outside air, that the air coming through the vents is a little warmer than the outside air. You can tell this by putting your hand out the window and feeling how cool the outside air really is. The difference is more pronounced when sitting still as would be expected.

Your description of warmer or cooler is obviously subjective. We can't tell from the internet how much warmer you are talking about. There is a possibility that the mechanism that responds to the temperature knob you rotate is not operating correctly. That is it may not be closing off the warmed air completely on the cool side. Not sure how that could be checked.

1: It's always warm when you start the AC, whether from start or driving, the compressor needs to power up, and some heat may be expelled.

2: When it's hot, open the rear windows when you first start the AC, expel the hot air, and also let fresh air in.

3: If you want the coolest AC, keep it on circulation mode, don't open the vents.
I have placed one of my photography thermometers in the air vents and I believe there is some heat leaking by the air dam which may not close 100%. On the Versa the hot water is always circulating through the heater core, whereas, on my 2003 Galant there is an electrically operated water valve that shuts of the hot water flow to the heater core in addition to the air dam that closes. I am tempted to install a shut off valve in the heater coolant hose in the engine compartment to improve the AC in the car which has to fight some of the heat sneaking by the air dam. Maybe a project for next year. I like what Mitsubishi did; the only drawback is having to replace the electric motor in the water valve every 9 years.
