Bought my first Nissan on 11-11-11, a 2012 Versa with a promise of great gas mileage.
The problem is that brand new with just over 1,000 miles and will on get 33.3.
That's a long way from the 40 plus it was suppose to get.

What should I do?

Are other people having the same problem?

Should I take the matter to small claims court?

No one claims 40mpg with any model versa so not sure what would justify your claim.

i think thats a little much to take it to court, i highly doubt every vehicle on the market will get spot on MPG. Nothing in this world is ever advertised 100% so i'd be happy your getting 33.3MPG

EPA has the 2012 hatch at 29mpg combined and the sedan at 33mpg combined. Who in the world told you that you get get 40? That's the person you should confront. I can get 40 from my 1.6 sedan but not without conscious driving.

And besides it sez on the window sticker in the epa ratings actual mileage may very based on driving habits, so thats out in case the car doesn't get the best mpgs mine only gets like 25mpg city (09 sedan 1.8)

If you are getting 33 at 1,000 miles, it probably get better. When I bought my '11, I was told that the car would 'loosen up' at 1500 miles, and mileage would improve. At 2000, the mpg got better.

I drive 75% hiway,25% city, coming up on 15,000 and get 34 or so. Summer w/ AC costs about 1 mpg, warming up in cold weather also 1 mpg. On longer hiway trips have cracked 36, not going slow. My Versa is a 6 spd HB.
